- Use the software to recover data from devices you do not legally own or have explicit authorization to access.
- Sublicense, rent, lease, or lend the software to third parties.
- Circumvent any technological protection measures or digital rights management (DRM) within the software.
- Use the Service for any unlawful or fraudulent purposes.
4. Technical Nature of Data Recovery (Important)
You acknowledge and agree that:
- No Guarantee: Data recovery is a technical process that depends on the state of the hardware and whether data has been overwritten. MobieArk does not guarantee that 100% of deleted or lost data can be recovered.
- Trial Version: We provide a "Free Scan/Preview" version. Users are strongly encouraged to use the preview function to verify if their data is recoverable before purchasing a license.
- Device Risk: While our software is designed to be safe, users acknowledge that software performance depends on the device’s integrity. MobieArk is not liable for any further data loss or device malfunction during the recovery process.
5. Intellectual Property
All rights, titles, and interests in and to the Service, including but not limited to software code, UI/UX design, logos, trademarks, and documentation, are the exclusive property of MobieArk and its licensors. These are protected by international copyright and intellectual property laws.
6. Payment, Subscriptions, and Taxes
Pricing: Prices for various license tiers are displayed on our website and are subject to change.
Billing: By providing a payment method, you authorize us to charge the applicable fees. Subscriptions may renew automatically unless cancelled in accordance with our cancellation policy.
Taxes: You are responsible for any applicable sales, use, or value-added taxes (VAT) related to your purchase.
7. Refund Policy
Our refund policy is governed by specific technical criteria (e.g., software failure to perform as advertised). Because data recovery results vary based on user behavior (e.g., continuing to use a phone after data loss), refunds are generally not granted for "data not found" if the preview function was available.
8. Privacy and Data Protection
Local Processing: MobieArk typically processes your iPhone data locally on your computer. We do not upload your personal files (photos, messages, contacts) to our servers.
Data Collection: We only collect minimal technical data (e.g., device model, OS version) and account information required for licensing and support.

9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBIEARK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
IN NO EVENT SHALL MOBIEARK, ITS DIRECTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR USE) ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Termination
We reserve the right to terminate or suspend your access to the Service at our sole discretion, without notice, if we believe you have breached these Terms. Upon termination, your license to use the software is immediately revoked.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law principles.
